Coverage from the recent budget announcement have confirmed that the government will implement a new National Living Wage for workers aged 25 and over, by introducing a new premium on top of the National Minimum Wage.
The new wage will be set at £7.20 per hour for those over the age of 25 and will come into place in April next year (2016).
Carrying over holiday when sick
Something else that has been covered in the news recently is that of carrying annual leave over when sick. It is well established by case law that employees continue to accrue holidays whilst absent from work due to illness and can even carry these holidays over into the next holiday year. However, sometime it can be unclear on whether an employee should prove they couldn’t take holiday due to illness.
Is an employee required to prove that they were unable to take the leave due to the illness in order to be entitled to carry it over?
The answer is quite simply no. In the recent case of Plumb v Duncan Print Group Limited it was found that an employee was not required to show that he was unable by reason of illness to take holiday, for it to be carried forward.
